This overview is intended to distribute some basic facts on development activities along Peachtree Industrial Blvd (PIB) which are adjacent to our community's streams, ponds and lake also known as "state waters."

PIB Development Facts:
  • PIB Development Parcel 6-268-043 is not in the City of Berkeley Lake
  • Gwinnett County is the "Issuing Authority" for permits and is responsible for site inspections and enforcement.
  • GPs Enterprises is the owner of this property and primary developer.
  • PIB Development LLC / Permit # RZC2007-00054
  • BLHA and the Mayor requested a performance bond for development activities. Gwinnett County did not support or pursue this effort.
  • BLHA documented and presented the high risks associated with this site to Gwinnett County and developer.
  • An estimated 22,000 truck loads of dirt were dumped on site in 2007.
    • 54" Storm water drainpipe crushed from depositing dirt
    • Cost to county taxpayers reported to exceed $700,000
    • Gwinnett County awarded contract for site repairs to GPs Enterprises
  • Ongoing impact to "State Waters" has been documented and reported over the past two years.
  • Complaint # 57783 was filed in May 2009 with Georgia Environmental Protection Division (EPD).
  • BLHA and homeowners are incurring expenses to document increasing amounts of silt in our watershed.
  • Gwinnett County issued first "Notice to Comply" in June 2009 and 2 citations to developer in July 2009
  • GPs Enterprises is actively attempting to sell this property.
  • BLHA recommended City of Berkeley Lake request Georgia EPD intervention.
  • Georgia EPD is intervening with the GPs Enterprises site based on the request from Berkeley Lake residents and city officials.
  • Chris and Marlene Holben (325 Lakeshore Drive) have experienced many issues with this area since 1981 at great expense and personal sacrifice.
  • Excerpt from United Consulting Report, dated 8/20/09: "In our opinion, the GP Site is still not adequately stabilized. Again, we recommend that GP Enterprises' site design engineer re-evaluate the sediment and erosion controls and provide appropriate design modifications."

Berkeley Lake Board of Directors requests our members and residents become involved and welcomes your assistance to increased attention to these issues by signing a petition at Berkeley Lake City Hall and sending emails or writing to government officials. Georgia EPD Addresses Runoff Issues

As your State Representative I was asked to become involved in resolving the run off issue that has plagued Berkeley Lake for some time. As I became aware of the situation I was most impressed with both the home owners association and the city government's actions to address the situation. To them should go any credit for the final resolution.

In discussing the issue with GA EPD officials it is clear that 1) the state is taking an active role to resolve the problem, 2) that the vehicle to do same will be a"Consent Order"with GPs Enterprises and 3) that the process has already begun and that the Consent Order should be filed within a month. The GA EPD has cautioned that this is an appealable order and therefore the resolution could be delayed. However, if GPs Enterprises is agreeable, land stabilization and clean up could occur within months.

I am committed to insure that this issue is resolved in a manner that provides a lasting solution. To that end I have asked the GA EPD officials to keep me abreast of developments. I will share that information with Berkeley Lake to the end that we all will find satisfaction.
